Article 1 — Definitions

Article 2 — Applicability

These general terms and conditions apply to every offer by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.

Before the distance contract is concluded, the text of these general terms and conditions shall be made available to the consumer.

Situations not covered by these general terms and conditions shall be assessed in the spirit of these general terms and conditions.

Article 3 — Right of Withdrawal

The consumer may terminate a contract relating to the purchase of a product during a cooling-off period of 14 days without giving any reason.

The cooling-off period referred to in paragraph 1 commences on the day after the consumer, or a third party designated in advance by the consumer who is not the carrier, has received the product.

Hygiene product exception: Pursuant to applicable consumer protection law, the right of withdrawal is excluded for products that are not suitable for return for reasons of hygiene or health protection and whose seal has been broken after delivery. Lascure helmets are delivered in sealed packaging. Once this seal has been broken, the right of withdrawal lapses.

If the consumer exercises their right of withdrawal, they shall notify the entrepreneur within the cooling-off period by email.

The consumer shall return the product with all supplied accessories, in its original condition and packaging, in accordance with the reasonable and clear instructions provided by the entrepreneur.

Article 4 — Prices and Payment

All prices are in euros and include VAT, unless otherwise stated.

During the validity period stated in the offer, the prices of the offered products shall not be increased, except for price changes resulting from changes in VAT rates.

The consumer has the obligation to immediately report any inaccuracies in provided or stated payment details to the entrepreneur.

Payment is made via the payment methods offered on the website (iDEAL, Bancontact, credit card, PayPal, or other methods offered by the entrepreneur).

Article 5 — Delivery

The entrepreneur shall exercise the greatest possible care when receiving and fulfilling orders for products.

The place of delivery shall be the address that the consumer has communicated to the entrepreneur.

The entrepreneur shall fulfill accepted orders within 30 days at the latest, unless a different delivery period has been agreed. If delivery is delayed, the consumer shall be notified.

The risk of damage and/or loss of products rests with the entrepreneur until the moment of delivery to the consumer or a pre-designated representative.

Article 6 — Warranty

The entrepreneur guarantees that the products conform to the contract, the specifications stated in the offer, and the reasonable requirements of soundness and/or usability.

Lascure provides a manufacturer's warranty of 1 (one) year on all products, commencing on the date of delivery.

This warranty covers defects in materials and workmanship under normal use. The warranty is void in cases of improper use, unauthorized modifications, or damage from external causes.

Article 7 — Complaints Procedure

Complaints about the performance of the contract must be submitted to the entrepreneur in a timely, complete, and clearly described manner after the consumer has discovered the defects.

Complaints submitted to the entrepreneur shall be answered within 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, the entrepreneur shall respond within 14 days with an acknowledgement of receipt and an indication of when the consumer can expect a more detailed response.

Article 8 — Applicable Law and Disputes

Contracts between the entrepreneur and the consumer to which these general terms and conditions apply are exclusively governed by Dutch law.

Disputes between the consumer and the entrepreneur may be submitted to the competent court in the district where the entrepreneur is established.
